TERMS & CONDITIONS

Last Updated: 11 September 2026

These Terms & Conditions govern your use of the Prop Kit Studio website and your purchase of services from Prop Kit Studio.

By using our website, submitting an enquiry, or purchasing a service through our website, you agree to these Terms & Conditions. Please read them carefully before placing an order.

1. About Prop Kit Studio

Prop Kit Studio provides creative design services, including custom email templates, email design, HTML email development, website design and related creative services.

Our services are provided on a project basis and are tailored according to the requirements, materials and information supplied by the client.

2. Services

The services available on our website may include:

  • Custom email templates
  • Email design and creative direction
  • HTML email development
  • Email collections
  • Website design and development
  • Other custom creative services agreed between Prop Kit Studio and the client

The exact deliverables included with a purchased service are determined by the package description, project agreement or written confirmation provided to the client.

Services described as “Starting From” are indicative starting prices and may vary depending on the scope, requirements and complexity of the project.

3. Orders & Payment

Payment is required before work begins for services purchased directly through our website, unless otherwise agreed in writing.

All prices displayed on the website are in USD, unless otherwise stated.

By completing a purchase, you confirm that:

  • You have reviewed the service description and included deliverables.
  • The information you provide to us is accurate.
  • You are authorised to purchase the service on behalf of yourself or your organisation.
  • You understand that creative work will begin after the required project materials have been received.

Payments may be processed through third-party payment providers such as PayPal. Their own terms and policies may also apply to the payment transaction.

4. Project Start

A project is considered ready to begin once:

  1. Payment has been successfully received; and
  2. Prop Kit Studio has received the required project materials from the client.

Required materials may include logos, brand guidelines, fonts, copy, photographs, property information, project details, links, contact information and other relevant content.

Production timelines may be affected if required materials are incomplete, inaccurate or delayed.

5. Client Responsibilities

The client is responsible for providing accurate and complete information and materials required for the project.

The client confirms that they have the necessary rights, permissions and licences to provide any text, images, logos, photographs, fonts, trademarks or other materials supplied to Prop Kit Studio.

Prop Kit Studio is not responsible for delays or issues caused by inaccurate, incomplete or late client materials.

6. Design & Creative Direction

Prop Kit Studio will create the work based on the agreed brief, supplied materials and the selected service.

Creative direction, layouts, typography, imagery, colours and other design decisions may be interpreted by Prop Kit Studio based on the project brief and brand requirements.

The client acknowledges that creative work is subjective and that minor differences between a reference, concept or expectation and the final design do not necessarily constitute a failure to provide the service.

7. Revisions

Revision rounds are limited to those included in the purchased package or agreed project scope.

For packages that include two revision rounds, the client may provide feedback during those two rounds.

Revision requests should be consolidated where reasonably possible.

Additional revisions, significant changes to the approved direction or requests outside the original scope may be charged separately. Any additional charges will be communicated before the additional work is undertaken.

8. Timelines & Delivery

Estimated production timelines begin once Prop Kit Studio has received all required materials and information.

Client review and response time is not included in production timelines.

Delays caused by missing materials, delayed feedback, changes to the brief or circumstances outside Prop Kit Studio’s reasonable control may extend the estimated delivery date.

For email projects, final deliverables may include completed HTML email files and/or other agreed design assets.

For website projects, delivery will depend on the agreed scope, development requirements, content and functionality.

9. Approval of Work

The client is responsible for reviewing the final work and confirming that the supplied information, links, contact details, pricing, property information and other content are accurate before publication or use.

Once a design or deliverable has been approved by the client, subsequent changes may be treated as additional work.

10. Email Compatibility

Email clients, browsers, devices and third-party email platforms may render HTML emails differently.

Prop Kit Studio will make reasonable efforts to create email templates suitable for commonly used email environments based on the agreed project requirements.

However, we cannot guarantee identical rendering across every email client, device, browser, operating system or third-party email marketing platform.

Third-party platform limitations, updates or changes may affect how an email is displayed.

11. Website Projects

For website projects, the agreed project fee covers only the scope specified in the relevant package, proposal or project agreement.

Additional pages, functionality, integrations, custom development, copywriting, photography, hosting, domain services, third-party software, plugins or other requirements may incur additional charges.

Any additional work outside the agreed scope will be discussed with the client before proceeding.

12. Intellectual Property

Unless otherwise agreed in writing, Prop Kit Studio retains ownership of its pre-existing design systems, processes, concepts, templates, source materials, working files, methods and proprietary resources.

Upon full payment, the client receives the agreed rights to use the final deliverables created specifically for their project for their own business or brand purposes.

The transfer of rights does not include third-party assets, fonts, stock imagery, software, plugins or other materials that are subject to separate licences or terms.

Unless otherwise agreed, Prop Kit Studio is not required to provide unused concepts, rejected designs, internal working files or development files that are not part of the agreed deliverables.

13. Client-Supplied Materials

The client retains ownership of materials they provide to Prop Kit Studio.

By providing materials to us, the client grants Prop Kit Studio permission to use those materials solely for the purpose of completing the agreed project.

The client is responsible for ensuring that supplied materials do not infringe the rights of any third party.

14. Portfolio & Promotional Use

Unless otherwise agreed in writing, Prop Kit Studio may display completed work created for a client in its portfolio, website, social media, presentations and other promotional materials.

If a project is confidential or subject to a non-disclosure agreement, Prop Kit Studio will respect the applicable confidentiality requirements.

15. Third-Party Services

Projects may involve third-party services, platforms or software, including hosting providers, email marketing platforms, payment providers, plugins, fonts, stock imagery or other external services.

Third-party services may have their own fees, terms, limitations and availability requirements.

Prop Kit Studio is not responsible for interruptions, changes, restrictions or failures caused by third-party services outside our reasonable control.

16. Refunds & Cancellations

Refunds and cancellations are handled according to our Refund & Cancellation Policy.

By purchasing a service, you acknowledge that you have reviewed that policy before completing your payment.

17. Chargebacks & Payment Disputes

If you experience an issue with a service or payment, we encourage you to contact Prop Kit Studio first so that we can review and resolve the matter where possible.

Unauthorised or improper chargebacks relating to services that have been provided or work that has already commenced may be disputed using the relevant payment provider’s procedures and available evidence.

Nothing in these Terms & Conditions limits any rights or protections available to you under applicable law.

18. Service Availability

We make reasonable efforts to keep our website and services available. However, we do not guarantee that the website will always be available, uninterrupted or error-free.

We may temporarily suspend or modify website features, services or content where reasonably necessary for maintenance, security, updates or other operational reasons.

19. Limitation of Liability

Prop Kit Studio will provide services with reasonable care and skill.

To the extent permitted by applicable law, Prop Kit Studio will not be responsible for indirect, incidental, consequential or unforeseeable losses arising from the use of our website, services or delivered materials.

This does not exclude or limit liability where such exclusion or limitation is not permitted by applicable law.

20. Force Majeure

Prop Kit Studio will not be responsible for delays caused by circumstances beyond our reasonable control, including technical failures, internet or hosting outages, third-party service interruptions, natural events, government actions, labour disruptions or other circumstances that could not reasonably have been prevented.

Where possible, we will communicate significant delays and work with the client to establish a reasonable revised timeline.

21. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our services, website, business practices or applicable requirements.

The latest version will be published on this page with the updated date.

Your continued use of the website or purchase of services after an update constitutes acceptance of the revised Terms & Conditions, to the extent permitted by applicable law.

22. Governing Law

These Terms & Conditions shall be governed by the laws applicable to Prop Kit Studio’s business and the jurisdiction in which it is legally established, subject to any mandatory consumer protection rights that apply to the client.

Any disputes will be handled in accordance with applicable law.
